The Food & Drug Administration issued a final rule amending regulations that describe the types of evidence relevant to determining whether a product is intended for use as a drug or device under the Federal Food, Drug, and Cosmetic Act. Effective September 1.
The Environmental Protection Agency issued a notice of rulemaking initiative to determine whether more stringent limitations and standards are appropriate and consistent with the technology-forcing statutory scheme and the goals of the Clean Water Act. EPA intends to sign the notice of proposed rulemaking for public comment in the Fall of 2022.
The Engineers Corps and EPA issued a notice that they intend to revise the definition of "waters of the United States," and will hold public meetings on August 18, August 23, August 25, August 26, and August 31. Comments on the notice are due September 3.
Haitian Hardship and Immigration
The U.S. Citizenship & Immigration Services issued a notice that certain individuals from Haiti can apply for Temporary Protected Status. The Dept. of Homeland Security also issued a notice to suspend certain regulatory requirements for F-1 nonimmigrant students whose country of citizenship is Haiti and who are experiencing severe economic hardship. Both actions are effective from Aug. 3, 2021 to Feb. 3, 2023.
The Dept. of Defense, General Services Administration & NASA issued a proposed rule addressing domestic preferences in government procurement. Comments due September 28.
The National Institute of Standards & Technology issued a request for information as it develops a framework that can be used to improve the management of risks to individuals, organizations, and society associated with artificial intelligence. Comments due August 19.
