Agency Rulemaking Highlights
|
The Dept. of Labor issued a final rule which says "independent contractors are workers who, as a matter of economic reality, are in business for themselves as opposed to being economically dependent on the potential employer for work." Effective March 8.
The Dept. of Homeland Security issued a final rule on prioritizing H-1B visas by "generally first selecting registrations based on the highest Occupational Employment Statistics prevailing wage level." Effective March 9.
The Fish & Wildlife Service issued a final rule that defines the scope of the Migratory Bird Treaty Act, and applies related regulations to actions directed only at migratory birds, their nests, or their eggs. Effective February 8.
The Environmental Protection Agency issued a final rule adopting greenhouse gas emission standards for certain domestic aircraft. Effective January 11.
The EPA issued a final rule where if an industry's GHG emissions make up less than 3% of US GHG emissions, any stationary source in that industry falls out of regulation under Section 111(b) of the Clean Air Act. Effective March 15.
The Federal Communications Commission issued a final rule to "publish a list of covered communications equipment and services determined to be a risk to national security." Effective March 15.
