The Dept. of Homeland Security will publish a notice of proposed rulemaking to permit collection of biometrics from aliens departing from airports, land ports, seaports, or any other authorized point of departure. There will be a 30 day comment period.
The Federal Trade Commission issued a proposed consent agreement to settle alleged violations of federal law prohibiting unfair or deceptive acts or practices. Comments due December 14.
The Environmental Protection Agency will issue a final rule redefining "major source" and "area source" of Section 112 of the CAA that apply to National Emission Standards for Hazardous Air Pollutants.
The Centers for Medicare & Medicaid Services issued a final rule streamlining the Medicaid and Children's Health Insurance Program regulatory framework. Effective December 14.
Employee Retirement Income Security Act
The Employee Benefits Security Administration issued a final rule requiring plan fiduciaries to select investments based solely on financial considerations, and a final rule establishing a registration process with the Dept. of Labor for retirement "pooled plan providers." Rules effective January 12 and November 16, respectively.
